Acceptable Use Policy

This Acceptable Use Policy governs what users may and may not do when accessing or using Kyttx, including platform activity, seller offerings, content, payments, communications, automations, and related conduct.

01Introduction

This Acceptable Use Policy governs what Users may and may not do when accessing or using the Kyttx Platform.

This Policy applies to all Users, including Sellers, Merchants, Buyers, Customers, Members, Operators, agencies, team members, contractors, affiliates, visitors, and any other person or entity that accesses or uses Kyttx.

This Policy is incorporated into and forms part of the Kyttx Master Terms of Service, Seller / Merchant Agreement, Buyer / Member Terms, Operator / Agency Terms, Payment, Payout & Fee Schedule, Refund, Chargeback & Dispute Policy, Content & Intellectual Property Policy, Privacy Policy, Data Processing Agreement, Arbitration & Dispute Resolution Agreement, and any other applicable Kyttx Policies.

By accessing or using Kyttx, you agree to comply with this Policy.

If you do not agree to this Policy, you must not use Kyttx.

02Purpose of This Policy

Kyttx is designed to help Sellers create, host, sell, manage, and deliver lawful, legitimate, and compliant offers, including coaching, consulting, cohorts, courses, communities, memberships, downloads, software access, calls, events, masterminds, and related services.

This Policy is intended to protect:

  • Kyttx.
  • Sellers.
  • Buyers.
  • Operators.
  • Payment providers.
  • Banks.
  • Card networks.
  • Service providers.
  • The integrity of the Platform.
  • The safety and rights of Users.
  • Legal and regulatory compliance.
  • The reputation and reliability of Kyttx.

Kyttx may take enforcement action against any User, account, Seller Offering, content, transaction, communication, automation, payout, or activity that Kyttx determines violates this Policy or creates unacceptable risk.

03Relationship to Other Terms

This Policy applies in addition to all other Kyttx terms and policies.

If there is a conflict between this Policy and the Kyttx Master Terms of Service, this Policy controls for acceptable use, prohibited activity, restricted activity, platform abuse, and compliance matters unless expressly stated otherwise.

If a Third-Party Payment Provider, bank, card network, service provider, regulator, law, or legal authority imposes stricter requirements than this Policy, the stricter requirement may apply.

Kyttx may enforce this Policy even if the activity occurs outside the Platform, where Kyttx determines that the activity relates to Kyttx, a Seller Offering, a Buyer, a Seller, payment activity, platform risk, legal risk, reputational risk, or User safety.

04Definitions

Capitalized terms used but not defined in this Policy have the meanings given in the Kyttx Master Terms of Service.

For purposes of this Policy:

?Prohibited Activity? means any activity, product, service, content, transaction, communication, automation, account use, or conduct that is not allowed on or in connection with Kyttx.

?Restricted Activity? means any activity, product, service, content, transaction, communication, automation, account use, or conduct that may require prior approval, additional review, additional disclosures, special controls, payout reserves, legal verification, payment provider approval, or other restrictions.

?High-Risk Activity? means activity that Kyttx determines may create elevated legal, financial, fraud, refund, chargeback, payment, reputational, compliance, sanctions, privacy, data, security, or operational risk.

?Seller Offering? means any product, service, course, cohort, coaching program, consulting service, community, membership, subscription, download, file, template, software access, call, event, mastermind, done-for-you service, agency service, or other offering made available by or on behalf of a Seller.

?Content? means any text, images, videos, audio, files, documents, templates, courses, pages, checkout copy, community posts, messages, automations, emails, SMS, forms, data, workflows, branding, logos, links, or materials uploaded, created, transmitted, hosted, published, displayed, or otherwise made available through or in connection with Kyttx.

05General User Responsibilities

You must use Kyttx lawfully, responsibly, and in compliance with this Policy.

You must not:

  • Violate applicable law.
  • Violate Kyttx Policies.
  • Violate payment provider rules.
  • Violate third-party rights.
  • Mislead Buyers, Sellers, Operators, Kyttx, payment providers, or other parties.
  • Create fraud, legal, payment, chargeback, security, privacy, compliance, reputational, or platform risk.
  • Use Kyttx for illegal, deceptive, abusive, or harmful activity.
  • Interfere with Kyttx?s operation.
  • Misuse Platform features.
  • Assist others in violating this Policy.

Kyttx may determine, in its discretion, whether activity violates this Policy or creates unacceptable risk.

06Allowed Seller Offerings

Subject to this Policy, other Kyttx Policies, applicable law, and payment provider requirements, Kyttx may support lawful Seller Offerings such as:

  • Coaching.
  • Consulting.
  • Cohorts.
  • Courses.
  • Educational content.
  • Digital downloads.
  • Communities.
  • Templates.
  • Software access.
  • SaaS-related access.
  • Done-for-you services.
  • Agency services.
  • Masterminds.
  • Events.
  • Calls.
  • Memberships.
  • Subscriptions.
  • Business services.
  • Professional services.
  • Creator services.
  • Other offerings approved or supported by Kyttx.

Allowed categories may still be restricted, reviewed, suspended, or prohibited if Kyttx determines that a specific Seller Offering is misleading, unlawful, high risk, abusive, unsupported, or otherwise unacceptable.

07Prohibited Seller Offerings

You may not create, sell, host, promote, deliver, manage, or facilitate Seller Offerings involving:

  • Scams, fraud, deceptive business opportunities, get-rich-quick schemes, fake income systems, or unsupported income claims.
  • Pyramid schemes, Ponzi schemes, unlawful or deceptive MLM schemes, unlawful reselling schemes, or deceptive lead generation.
  • Fake clients, fake leads, fake appointments, counterfeit goods, stolen content, or unauthorized resale of third-party content.
  • Fake documents, fake IDs, identity fraud, phishing, hacking, malware, spyware, credential theft, or account takeover services.
  • Spam tools, botting services, unlawful scraping, unlawful data harvesting, illegal drugs, controlled substances, weapons, restricted weapons, illegal goods, or illegal services.
  • Stolen goods, money laundering, terrorist financing, sanctions evasion, tax evasion, fraudulent chargeback services, refund abuse services, or payment manipulation.
  • Gambling, betting, sports betting, lotteries, games of chance, casino-like activity, adult content, sexually explicit services, escort services, pornography, or sexual exploitation.
  • Unlawful health or medical claims, unlawful financial services, unlicensed investment advice, unlicensed legal services, or regulated products or services without required authorization.
  • Hate, harassment, exploitation, abusive content, threats, violence, incitement, or any offering prohibited by Kyttx, payment providers, banks, card networks, law, or regulators.

Kyttx may remove, restrict, suspend, or terminate any Seller Offering that Kyttx determines falls within a prohibited category.

08Restricted Seller Offerings

Some Seller Offerings may be allowed only with prior approval, additional disclosures, additional controls, payout reserves, legal documentation, payment provider approval, or other restrictions.

Restricted categories may include:

  • Crypto-related education, trading-related education, finance-related education, investing-related education, or business opportunity education.
  • High-ticket business coaching, income-related coaching, agency scaling programs, sales training involving income claims, or marketing programs involving revenue claims.
  • Wellness services, fitness services, appearance-related services, looks-related services, health-adjacent services, mindset or personal transformation programs.
  • Tax-related education, legal-related education, professional licensing-related education, regulated or semi-regulated industries.
  • High-ticket offers, long-term payment plans, aggressive guarantees, trial-to-paid offers, buy-now-pay-later offers, or any category Kyttx determines is high risk.

Kyttx may approve, reject, restrict, suspend, or revoke approval for Restricted Activity at any time.

Approval of a Restricted Activity does not mean Kyttx endorses the activity or accepts responsibility for it.

09Income Claims, Business Claims, and Result Claims

You must not make false, deceptive, exaggerated, unsupported, or misleading claims about income, revenue, profit, sales, clients, leads, return on investment, business growth, financial freedom, passive income, guaranteed customers, guaranteed appointments, guaranteed results, guaranteed transformation, health results, fitness results, appearance results, personal outcomes, professional outcomes, or any other result.

You must not suggest that Buyers are likely to achieve extraordinary results unless those results are typical, properly substantiated, and clearly explained.

You must not use fake screenshots, fabricated earnings, manipulated dashboards, false testimonials, fake case studies, fake reviews, misleading before-and-after content, or cherry-picked claims without proper context.

If you make claims about results, you must have reliable evidence to support those claims.

If results are not guaranteed, you must clearly disclose that results are not guaranteed.

If you provide a guarantee, the guarantee must be lawful, clear, written, enforceable, and fully disclosed before purchase.

10Guarantees

You must not advertise, imply, or provide a guarantee unless you clearly disclose all material terms.

Guarantee terms must include, where applicable:

  • What is guaranteed.
  • What is not guaranteed.
  • Eligibility requirements.
  • Buyer obligations.
  • Deadlines.
  • Refund amount.
  • Evidence required.
  • Exclusions.
  • Request process.
  • Access consequences.
  • Limitations.
  • Any other material conditions.

You must not use impossible, hidden, unfair, abusive, or deceptive guarantee conditions.

Kyttx may require you to modify, remove, or honor a guarantee.

Kyttx may require or facilitate refunds where a Seller advertises a guarantee and fails to honor it.

11Refund and Cancellation Terms

Sellers must clearly disclose refund and cancellation terms before purchase.

You must not:

  • Hide refund terms.
  • Use unclear refund terms.
  • Change refund terms after purchase without Buyer consent.
  • Advertise refunds you do not honor.
  • Advertise guarantees you do not honor.
  • Impose impossible refund conditions.
  • Impose abusive refund conditions.
  • Use misleading cancellation flows.
  • Mislead Buyers about subscription cancellation.
  • Mislead Buyers about payment plan obligations.
  • Refuse legally required refunds.
  • Retaliate against Buyers for requesting refunds.
  • Instruct Buyers to file chargebacks instead of handling valid refunds.

Kyttx may require changes to refund or cancellation terms that create legal, payment, chargeback, or platform risk.

12Subscriptions, Payment Plans, Installments, and Trials

If you offer subscriptions, payment plans, installments, recurring payments, trials, or trial-to-paid billing, you must clearly disclose all material terms before purchase.

You must disclose:

  • Total price.
  • Recurring amount.
  • Billing frequency.
  • Renewal terms.
  • Trial length.
  • Trial conversion date.
  • Post-trial price.
  • Installment schedule.
  • Payment plan obligations.
  • Cancellation process.
  • Refund terms.
  • Failed payment consequences.
  • Access consequences.
  • Taxes.
  • Any other material terms.

You must comply with applicable laws relating to subscriptions, auto-renewals, cancellation, payment plans, installments, financing-like arrangements, consumer disclosures, and recurring payments.

Kyttx may restrict or suspend billing features where terms are unclear, misleading, unlawful, or high risk.

13Gambling, Betting, and Games of Chance

Unless expressly approved in writing by Kyttx and legally permitted, you may not use Kyttx for gambling, betting, sports betting, casino activity, lotteries, raffles, sweepstakes, games of chance, wagering, prediction markets, gambling tips, betting groups, betting signals, arbitrage betting schemes, gambling-related communities, gambling-related software, or services that facilitate gambling or betting.

Kyttx may prohibit gambling-related activity even if it is legal in a specific jurisdiction if Kyttx determines that it creates payment, legal, regulatory, reputational, or platform risk.

14Crypto, Trading, Investing, and Financial Content

Crypto, trading, investing, foreign exchange, securities, commodities, financial education, and related activities may be restricted.

You may not use Kyttx to provide:

  • Unlicensed investment advice.
  • Securities offerings.
  • Investment management.
  • Broker-dealer services.
  • Trading signals without approval.
  • Crypto pump-and-dump schemes.
  • Guaranteed trading returns.
  • Guaranteed investment profits.
  • Deceptive crypto communities.
  • Unlawful token sales.
  • Unlawful forex services.
  • Illegal financial promotions.
  • Custodial financial services.
  • Money transmission.
  • Payment services requiring licensing.
  • Any regulated financial service without authorization.

Educational content may be allowed if it is lawful, clearly educational, not misleading, properly disclosed, and approved where required.

Kyttx may require disclaimers, legal proof, licensing information, payment provider approval, or other documentation.

15Health, Fitness, Wellness, Appearance, and Looks-Related Content

Health, fitness, wellness, appearance, looks-related, medical, mental health, nutrition, supplement, therapy, or similar content may be restricted.

You may not use Kyttx to provide:

  • Unlawful medical advice.
  • False health claims.
  • Unsupported treatment claims.
  • Claims to cure, treat, diagnose, or prevent disease without proper authority.
  • Unsafe fitness instructions.
  • Harmful diet or body-image content.
  • Unlawful supplement claims.
  • Deceptive before-and-after claims.
  • Misleading appearance transformation claims.
  • Unlicensed therapy or medical services.
  • Emergency medical services.
  • Any health-related service requiring licensing without authorization.

Educational or coaching content may be allowed where lawful, properly disclosed, not misleading, and not presented as professional medical care unless legally authorized.

Kyttx may require disclaimers, credentials, licensing proof, or other documentation.

16Adult Content and Sexual Content

You may not use Kyttx to create, sell, host, promote, deliver, manage, or facilitate pornography, sexually explicit content, adult subscriptions, escort services, sexual services, sexual exploitation, content involving minors, non-consensual sexual content, intimate image abuse, adult live streaming, adult communities, fetish content, sexual coaching involving explicit material, or any activity prohibited by law, payment providers, or Kyttx.

Kyttx may remove or restrict any content or account that Kyttx determines involves adult or sexual content.

17Illegal, Regulated, or Licensed Activities

You may not use Kyttx to offer products or services that are illegal, require licensing you do not have, or are restricted by law, payment providers, or Kyttx.

This may include:

  • Legal services without authorization.
  • Tax services without authorization.
  • Medical services without authorization.
  • Financial services without authorization.
  • Investment services without authorization.
  • Insurance services without authorization.
  • Credit repair services where restricted.
  • Debt collection services where restricted.
  • Immigration services where restricted.
  • Professional licensing services where restricted.
  • Government document services.
  • Regulated education where licensing is required.
  • Any other regulated service without required authorization.

Kyttx may request evidence of licensing, registration, insurance, authorization, or legal compliance.

18Sanctions, Export Controls, and Restricted Countries

You may not use Kyttx if you are located in, organized under the laws of, ordinarily resident in, or acting on behalf of a country, region, person, entity, or organization subject to sanctions, embargoes, restrictions, or prohibitions applicable to Kyttx, its payment providers, or its service providers.

You must not:

  • Sell to sanctioned persons.
  • Buy from sanctioned persons.
  • Transact with sanctioned entities.
  • Evade sanctions.
  • Use intermediaries to bypass restrictions.
  • Misrepresent location.
  • Misrepresent identity.
  • Route payments through restricted jurisdictions.
  • Provide access to restricted jurisdictions where prohibited.
  • Violate export controls.

Kyttx may block, restrict, suspend, or terminate accounts, payments, payouts, Seller Offerings, or access based on sanctions, export controls, restricted country rules, payment partner requirements, or risk determinations.

19Fraud and Deception

You must not use Kyttx for fraud, deception, or dishonest conduct.

Prohibited conduct includes:

  • Fake identities, false account information, fake business information, fake tax information, or fake payment information.
  • Fake Buyer accounts, fake purchases, fake reviews, fake testimonials, fake case studies, fake screenshots, fake scarcity, fake urgency, or fake guarantees.
  • False claims of certification, false claims of endorsement, impersonation, misrepresentation of Seller identity, misrepresentation of Buyer identity, or misrepresentation of Kyttx involvement.
  • Phishing, social engineering, payment fraud, chargeback fraud, refund fraud, account takeover, or any other fraudulent or deceptive activity.

20Payment Abuse

You must not use Kyttx payment-related features for abusive, unlawful, deceptive, or high-risk payment activity.

Prohibited payment activity includes:

  • Money laundering, terrorist financing, sanctions evasion, card testing, stolen payment methods, fake transactions, sham transactions, or cash advances.
  • Self-dealing transactions designed to move funds, transaction laundering, processing payments for undisclosed third parties, or splitting transactions to avoid limits.
  • Manipulating chargeback rates, manipulating refund rates, evading reserves, evading payment provider rules, misleading payment providers, hidden payment terms, unauthorized recurring billing, unauthorized payment plans, abusive collection practices, or any activity prohibited by payment providers, banks, card networks, or Kyttx.

Kyttx may restrict, suspend, hold, reverse, refund, report, or terminate payment-related activity that violates this Policy.

21Chargeback and Refund Abuse

Buyers must not abuse refund or chargeback processes.

Prohibited Buyer conduct includes:

  • Filing false chargebacks or bad-faith payment disputes.
  • Claiming non-delivery after receiving access.
  • Requesting refunds after copying or downloading content.
  • Repeatedly purchasing and refunding.
  • Misrepresenting facts to banks.
  • Using chargebacks to avoid payment plans.
  • Threatening Sellers with disputes in bad faith.
  • Exploiting refund policies.
  • Using multiple accounts to bypass restrictions.

Sellers must not abuse refund or chargeback processes.

Prohibited Seller conduct includes:

  • Hiding refund terms.
  • Refusing valid refunds.
  • Changing refund terms after purchase.
  • Instructing Buyers to file chargebacks instead of refunds.
  • Manipulating evidence.
  • Submitting false dispute evidence.
  • Threatening Buyers.
  • Retaliating against Buyers.
  • Using deceptive collection practices.
  • Creating excessive chargeback risk.

22Platform Security Abuse

You must not compromise, disrupt, attack, or misuse Kyttx systems.

Prohibited security activity includes:

  • Hacking, credential stuffing, password spraying, brute force attacks, account takeover, or unauthorized access.
  • Scanning without permission, probing without permission, penetration testing without permission, exploiting vulnerabilities, bypassing access controls, or bypassing permissions.
  • Interfering with authentication, payment flows, payout flows, or Platform operations.
  • Uploading malware, distributing malware, introducing harmful code, denial-of-service attacks, excessive automated requests, scraping without permission, reverse engineering the Platform, copying Platform infrastructure, abusing APIs, abusing webhooks, abusing forms, abusing automations, abusing URL shorteners, or abusing file hosting.

Kyttx may take immediate enforcement action for security abuse.

23Spam, Communication Abuse, and Messaging Rules

You must not use Kyttx communication tools for spam, harassment, deception, or unlawful marketing.

Prohibited communication activity includes unsolicited marketing without proper consent, spam emails, spam SMS, spam messages, fake sender identities, deceptive subject lines, misleading message content, harassment, threats, abusive language, phishing messages, malware links, unlawful cold outreach, failure to honor unsubscribe requests, messaging Buyers for unrelated purposes, selling Buyer contact data, or sending messages in violation of anti-spam, privacy, telecommunications, or marketing laws.

Kyttx may throttle, suspend, review, block, or terminate communication features.

24Privacy and Data Abuse

You must not misuse personal data, Buyer Data, Seller Data, Operator Data, or other User information.

Prohibited privacy and data activity includes:

  • Selling Buyer Data without authorization.
  • Exporting data without authorization.
  • Sharing data with unauthorized persons.
  • Using Buyer Data for unrelated marketing.
  • Contacting Buyers without proper legal basis.
  • Scraping personal data.
  • Collecting unnecessary sensitive information.
  • Collecting data without disclosure or consent where required.
  • Violating privacy laws or data protection laws.
  • Misusing analytics data or customer lists.
  • Using data after account termination without authorization.
  • Failing to protect data.
  • Failing to report data incidents where required.
  • Attempting to access data outside assigned permissions.

Kyttx may restrict access to data or accounts where privacy risk exists.

25Intellectual Property Abuse

You must not use Kyttx to infringe intellectual property rights.

Prohibited activity includes uploading stolen content, uploading copyrighted content without rights, selling pirated materials, copying another Seller?s content, copying templates without permission, copying courses without permission, using unauthorized trademarks, impersonating brands, selling counterfeit goods, using another person?s likeness without rights, removing copyright notices, distributing leaked content, reselling content without authorization, using Kyttx branding without permission, or claiming Kyttx endorsement without permission.

Kyttx may remove content, disable accounts, terminate repeat infringers, and cooperate with rights holders where appropriate.

26Harassment, Abuse, and Harmful Conduct

You must not harass, threaten, abuse, exploit, or harm other Users, Kyttx staff, payment providers, or third parties.

Prohibited conduct includes threats, harassment, bullying, stalking, doxxing, extortion, blackmail, intimidation, hate speech, incitement to violence, abusive community conduct, discriminatory abuse, exploitation, non-consensual sharing of private information, abusive support interactions, threats of bad-faith legal action, threats of false chargebacks, or threats of reputational harm in bad faith.

Kyttx may immediately restrict, suspend, or terminate Users involved in abusive conduct.

27Content Standards

Content uploaded, created, hosted, transmitted, or displayed through Kyttx must be lawful, accurate where presented as factual, and compliant with this Policy.

Content must not be illegal, fraudulent, misleading, defamatory, abusive, harassing, hateful, sexually explicit, exploit minors, promote violence, promote terrorism, infringe rights, violate privacy, include malware, include phishing links, include scams, include prohibited products or services, misrepresent identity, misrepresent results, or create unacceptable risk.

Kyttx may remove, restrict, or disable Content at any time.

28Marketplace, Storefront, and Public Page Abuse

Kyttx may provide hosted storefronts, checkout pages, landing pages, public pages, or future discovery or marketplace-style features.

You must not use such features to mislead Buyers, impersonate another brand, create fake listings, create fake scarcity, hide material terms, manipulate rankings, manipulate reviews, create duplicate abusive accounts, use deceptive SEO, scrape or copy other pages, publish prohibited offers, publish misleading claims, direct Buyers to unsafe or unlawful off-platform activity, bypass Kyttx payment flows where prohibited, evade fees, or evade compliance review.

Kyttx may remove or restrict storefronts, pages, listings, or visibility at any time.

29Off-Platform Conduct

Kyttx may consider off-platform conduct when determining whether you violate this Policy.

Off-platform conduct may include social media claims, ads, direct messages, sales calls, webinars, external checkout pages, external refund terms, affiliate promotions, community behavior, public complaints, legal claims, regulator reports, payment provider reports, Buyer reports, Seller reports, Operator activity, or reputationally harmful conduct related to Kyttx or Seller Offerings.

Kyttx may take action if off-platform conduct relates to Kyttx, Seller Offerings, Buyers, Sellers, Operators, payments, disputes, legal risk, or platform integrity.

30Use of Kyttx Branding

You must not use Kyttx?s name, logo, trademarks, branding, screenshots, interface, designs, or materials in a way that suggests endorsement, certification, partnership, employment, agency, guarantee, sponsorship, official approval, responsibility by Kyttx, or special status.

You may truthfully state that you use Kyttx, provided the statement is accurate and not misleading.

Kyttx may require removal or modification of any reference to Kyttx.

31AI and Automation Abuse

If Kyttx provides AI tools, automation tools, generated pages, generated copy, workflows, recommendations, or similar features, you must use them responsibly.

You must not use AI or automation tools to create illegal content, create misleading claims, create fake testimonials, create fake reviews, impersonate others, generate spam, generate phishing content, generate malware, bypass legal obligations, automate harassment, automate abusive messaging, scrape data unlawfully, make regulated claims without review, replace required legal, tax, financial, medical, or professional review, or mislead Buyers.

You are responsible for reviewing and approving all AI-generated or automated output before use.

32File Hosting and Download Abuse

If Kyttx provides file hosting or download features, you must not upload, host, share, or distribute malware, pirated files, stolen files, leaked content, illegal files, counterfeit documents, fake documents, adult files, exploitative content, confidential information without authorization, files that infringe rights, files that violate privacy, files that facilitate scams, files that facilitate fraud, or files that create security risk.

Kyttx may scan, restrict, remove, or disable files where appropriate.

33URL Shortener and Custom URL Abuse

If Kyttx provides custom URL, domain, or URL-shortening features, you must not use them for phishing, malware, spam, scams, impersonation, deceptive redirects, cloaking, bypassing platform review, hiding prohibited offers, redirecting to illegal content, redirecting to adult content, redirecting to gambling or betting, redirecting to payment abuse, violating third-party rights, or misleading Buyers.

Kyttx may disable links, URLs, domains, redirects, or related features at any time.

34Affiliate, Referral, and Promoter Abuse

If Kyttx provides affiliate, referral, commission, or promoter tools, Users must not use them for fake referrals, self-referrals where prohibited, referral fraud, misleading promotions, spam, undisclosed paid promotion, fake testimonials, false income claims, prohibited offers, commission manipulation, refund manipulation, chargeback manipulation, or unauthorized use of Buyer Data.

Sellers are responsible for affiliates, promoters, influencers, contractors, Operators, and representatives who promote their Seller Offerings.

35Operator and Agency Abuse

Operators and agencies must not:

  • Access Seller Accounts without authorization.
  • Exceed permissions.
  • Change payout settings without authorization and technical permission.
  • Misuse Buyer Data.
  • Steal Seller Content.
  • Copy Seller strategies without authorization.
  • Sabotage Seller accounts.
  • Delete content without authorization.
  • Issue refunds without authorization.
  • Create prohibited offers.
  • Create misleading claims.
  • Impersonate Sellers.
  • Impersonate Kyttx.
  • Misrepresent authority.
  • Use Seller accounts for unrelated purposes.
  • Continue accessing accounts after authorization ends.

Kyttx may remove Operator access at any time.

36Buyer Misuse

Buyers must not:

  • Share account access.
  • Resell Seller Content.
  • Leak Seller Content.
  • Copy Seller Content.
  • Scrape Seller Content.
  • Distribute downloads without permission.
  • File false chargebacks.
  • Abuse refunds.
  • Harass Sellers or other Buyers.
  • Violate community rules.
  • Record calls without required permission.
  • Misuse Seller confidential information.
  • Misuse other Buyers? information.
  • Bypass access controls.
  • Access content after refund or chargeback unless permitted.

Kyttx may suspend or terminate Buyer access for misuse.

37High-Risk Activity Review

Kyttx may review any account, Seller Offering, transaction, payout, content, communication, automation, or User activity that Kyttx determines is high risk.

Kyttx may consider pricing, transaction size, payment method, country, currency, chargeback rate, refund rate, Buyer complaints, Seller history, account age, claim type, industry category, payment provider requirements, legal requirements, sanctions risk, fraud indicators, platform reputation, and other risk factors.

Kyttx may require additional information, restrict activity, require reserves, delay payouts, suspend accounts, remove content, or terminate access based on high-risk review.

38Required Information and Cooperation

You must provide information requested by Kyttx for compliance, risk, fraud, payment, sanctions, tax, legal, security, or enforcement purposes.

Requested information may include:

  • Identity information.
  • Business information.
  • Tax information.
  • Ownership information.
  • Payout information.
  • Seller Offering details.
  • Refund policies.
  • Marketing materials.
  • Evidence supporting claims.
  • Licensing information.
  • Proof of authorization.
  • Buyer communications.
  • Dispute evidence.
  • Transaction records.
  • Other relevant information.

Failure to provide requested information may result in restriction, suspension, payout holds, reserves, or termination.

39Enforcement Actions

If Kyttx determines that you violated this Policy or created unacceptable risk, Kyttx may take any action it determines appropriate.

Enforcement actions may include:

  • Warning.
  • Request for changes.
  • Content removal.
  • Seller Offering removal.
  • Page removal.
  • URL disabling.
  • Checkout disabling.
  • Payment method restriction.
  • Payout delay.
  • Payout freeze.
  • Reserve requirement.
  • Refund initiation.
  • Access restriction.
  • Buyer access removal.
  • Operator access removal.
  • Account suspension.
  • Account termination.
  • Data export restriction.
  • Communication throttling.
  • Communication suspension.
  • Reporting to payment providers, banks, card networks, regulators, or law enforcement.
  • Arbitration or legal action.
  • Collection of amounts owed.
  • Any other action Kyttx determines necessary.

Kyttx may take enforcement action with or without prior notice.

40No Obligation to Monitor

Kyttx may monitor, review, investigate, or audit activity, but Kyttx has no obligation to monitor all activity, content, Seller Offerings, communications, transactions, or Users.

Kyttx is not responsible for failing to detect prohibited activity, unlawful conduct, misleading content, or User misconduct.

Kyttx?s decision to allow, remove, approve, restrict, or reject any activity does not make Kyttx responsible for that activity.

41Reporting Violations

Users may report suspected violations of this Policy to:

Reports should include, where available:

  • The relevant account.
  • The relevant Seller Offering.
  • The relevant URL.
  • Screenshots.
  • Transaction details.
  • Communications.
  • Explanation of the issue.
  • Any evidence supporting the report.

Kyttx may investigate reports at its discretion.

Kyttx is not required to provide updates, disclose investigation results, or take requested action.

42False Reports

You must not submit false, misleading, abusive, retaliatory, or bad-faith reports.

Kyttx may restrict or terminate Users who abuse reporting systems.

43Appeals

Kyttx may, at its discretion, allow Users to appeal certain enforcement actions.

Appeals should include:

  • Account information.
  • Explanation of why the action should be reversed.
  • Supporting evidence.
  • Corrective steps taken.
  • Any additional information requested by Kyttx.

Kyttx may accept, reject, or ignore appeals at its discretion.

Kyttx is not required to reinstate accounts, content, payouts, features, or access.

44Cooperation with Third Parties

Kyttx may share information with third parties where necessary or appropriate to enforce this Policy, comply with law, manage risk, or protect the Platform.

Third parties may include:

  • Payment providers.
  • Banks.
  • Card networks.
  • Fraud prevention providers.
  • Compliance providers.
  • Tax providers.
  • Hosting providers.
  • Analytics providers.
  • Legal advisors.
  • Regulators.
  • Law enforcement.
  • Courts.
  • Arbitrators.
  • Affected Users.
  • Rights holders.
  • Other service providers.

Information sharing will be handled in accordance with applicable law and Kyttx?s Privacy Policy.

45Effect of Termination

If your account or access is terminated for violating this Policy, Kyttx may:

  • Disable your account.
  • Remove Seller Offerings.
  • Disable checkout.
  • Disable hosted pages.
  • Remove content.
  • Restrict Buyer access.
  • Restrict Operator access.
  • Restrict data export.
  • Delay payouts.
  • Freeze payouts.
  • Require reserves.
  • Offset amounts owed.
  • Recover negative balances.
  • Notify affected Buyers.
  • Notify payment providers.
  • Preserve records.
  • Cooperate with legal authorities.
  • Pursue legal or arbitration remedies.

Termination does not relieve you of obligations arising before termination.

46Disclaimers

Kyttx does not guarantee that the Platform will be free from prohibited activity, misleading content, unlawful Seller Offerings, fraudulent Users, abusive Buyers, or other misconduct.

Kyttx is not responsible for User conduct, Seller Offerings, Seller Content, Buyer conduct, Operator conduct, payment provider decisions, or third-party services, except to the extent liability cannot be excluded by law.

Use of Kyttx is at your own risk.

47Limitation of Liability

To the maximum extent permitted by law, Kyttx is not liable for losses arising out of or relating to enforcement of this Policy, failure to enforce this Policy, account suspension, account termination, content removal, checkout disabling, payout holds, reserves, payment restrictions, Seller Offering removal, Buyer access removal, Operator access removal, reports to payment providers, reports to regulators, reports to law enforcement, User misconduct, prohibited activity, third-party decisions, lost revenue, lost profits, reputational harm, or indirect damages.

Kyttx?s liability is limited as provided in the Kyttx Master Terms of Service and applicable agreements.

48Indemnification

You agree to defend, indemnify, and hold harmless Kyttx and its owners, directors, officers, employees, contractors, agents, affiliates, licensors, service providers, and payment partners from and against any claims, demands, disputes, losses, liabilities, damages, fines, penalties, costs, and expenses, including reasonable legal fees, arising out of or relating to:

  • Your violation of this Policy.
  • Your prohibited activity.
  • Your restricted activity.
  • Your Seller Offerings.
  • Your Content.
  • Your marketing claims.
  • Your income claims.
  • Your guarantees.
  • Your payment abuse.
  • Your chargebacks.
  • Your refund abuse.
  • Your fraud.
  • Your misuse of data.
  • Your privacy violations.
  • Your intellectual property violations.
  • Your security abuse.
  • Your communications.
  • Your use of AI or automations.
  • Your use of Operators, affiliates, contractors, or team members.
  • Your violation of law.
  • Your violation of payment provider rules.
  • Your harm to Kyttx, Users, payment providers, or third parties.

49Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to this Policy, enforcement actions, prohibited activity, restricted activity, account restrictions, content removal, payout holds, reserves, platform abuse, User conduct, or related matters will be resolved according to the Kyttx Arbitration & Dispute Resolution Agreement and the dispute resolution provisions in the Kyttx Master Terms of Service.

Unless mandatory law requires otherwise:

  • Governing law shall be the laws of the Dubai International Financial Centre.
  • Arbitration shall be administered by the Dubai International Arbitration Centre.
  • The seat of arbitration shall be the Dubai International Financial Centre, Dubai, United Arab Emirates.
  • The language shall be English.
  • The tribunal shall consist of one arbitrator.
  • Disputes shall be confidential.
  • Claims must be brought individually and not as class, collective, consolidated, representative, or group claims.
  • The prevailing party may recover costs and legal fees where permitted.

Before commencing arbitration, the party raising the dispute must provide written notice and allow 30 days for informal resolution.

Kyttx may seek urgent court relief for fraud, non-payment, negative balances, chargebacks, payment abuse, security threats, sanctions issues, illegal activity, data misuse, intellectual property misuse, confidentiality breaches, or other urgent harm.

50Modifications

Kyttx may modify this Policy from time to time.

Kyttx may provide notice by posting an updated version, updating the ?Last Updated? date, sending email notice, displaying in-app notice, updating the dashboard, or using another reasonable method.

Changes are effective when posted or when otherwise stated.

Your continued use of the Platform after changes become effective constitutes acceptance of the updated Policy.

Kyttx may make immediate changes where required or appropriate due to legal requirements, payment partner requirements, security issues, fraud risk, chargeback risk, compliance issues, operational changes, sanctions issues, tax requirements, or urgent platform needs.

51Survival

Obligations under this Policy survive account suspension, account termination, Seller Offering removal, Buyer access termination, payout completion, transaction completion, or discontinuation of the Platform.

Surviving obligations include obligations relating to prohibited activity, refunds, chargebacks, payment abuse, data misuse, intellectual property violations, confidentiality, indemnification, dispute resolution, legal compliance, record retention, and enforcement.
