These terms govern access to and use of Kyttx by Operators, agencies, contractors, consultants, service providers, team members, and others who manage or assist with Seller accounts, Seller Offerings, Seller Content, Buyer Data, automations, funnels, or related activity.

01Introduction
These Operator / Agency Terms govern your access to and use of Kyttx as an Operator, agency, contractor, consultant, offer builder, funnel builder, growth operator, service provider, team member, employee, representative, account manager, strategist, automation builder, or other person or entity that is invited, authorized, or permitted to access, configure, manage, operate, create, edit, optimize, or assist with any Seller account, Seller Offering, Seller Content, Seller storefront, Seller funnel, Seller automation, Seller customer data, or Seller-related activity through or in connection with the Kyttx Platform.
These Operator Terms are incorporated into and form part of the Kyttx Master Terms of Service.
By accepting an invitation to a Seller account, accessing a Seller account, managing Seller features, creating or editing Seller Offerings, building pages or funnels, managing automations, accessing Buyer Data, assisting a Seller, receiving revenue share or payouts, or otherwise using Kyttx as an Operator, you agree to these Operator Terms, the Kyttx Master Terms of Service, and all applicable Kyttx Policies.
If you do not agree to these Operator Terms, you must not access or use Kyttx as an Operator.
02Relationship to Other Terms
These Operator Terms apply in addition to the Kyttx Master Terms of Service.
You may also be subject to:
- The Kyttx Seller / Merchant Agreement.
- The Kyttx Payment, Payout & Fee Schedule.
- The Kyttx Refund, Chargeback & Dispute Policy.
- The Kyttx Acceptable Use Policy.
- The Kyttx Content & Intellectual Property Policy.
- The Kyttx Privacy Policy.
- The Kyttx Cookie Policy.
- The Kyttx Data Processing Agreement.
- The Kyttx Arbitration & Dispute Resolution Agreement.
- The Kyttx Sanctions, Restricted Countries & Compliance Policy.
- Any Third-Party Payment Provider terms.
- Any additional policies, schedules, product terms, notices, permissions, or account rules published by Kyttx.
If there is a conflict between these Operator Terms and the Master Terms of Service, these Operator Terms control for Operator-specific matters unless expressly stated otherwise.
If there is a conflict between these Operator Terms and a separate written agreement between you and a Seller, these Operator Terms control for your access to and use of Kyttx.
03Definitions
Capitalized terms used but not defined in these Operator Terms have the meanings given in the Kyttx Master Terms of Service.
For purposes of these Operator Terms:
?Operator? means any person, agency, contractor, consultant, employee, team member, service provider, account manager, offer builder, funnel builder, growth operator, automation builder, or third party invited, authorized, or permitted by a Seller or Kyttx to access, configure, create, manage, optimize, operate, or assist with any part of a Seller account or Seller-related activity.
?Seller? means the person or entity that owns, controls, or operates a Seller account or Seller Offering.
?Seller Account? means the Kyttx account, dashboard, storefront, workspace, or related Platform environment used by a Seller.
?Seller Offering? means any product, service, course, cohort, community, membership, subscription, coaching program, consulting service, digital download, file, template, software access, call, event, mastermind, done-for-you service, agency service, or other offering made available by or on behalf of a Seller.
?Seller Content? means content, materials, files, pages, videos, images, text, designs, automations, workflows, branding, logos, trademarks, pricing, claims, descriptions, checkout copy, refund policies, community content, messages, or other materials uploaded, created, edited, transmitted, hosted, or made available by or on behalf of a Seller.
?Buyer Data? means information relating to Buyers, Customers, or Members, including names, email addresses, purchase history, access status, account activity, communications, form submissions, analytics data, and other information processed through the Platform.
?Permissions? means the access rights, controls, features, roles, restrictions, or settings assigned to an Operator by a Seller or Kyttx.
04Operator Status
You agree that you access and use Kyttx as an independent person or business, not as an employee, agent, partner, joint venturer, legal representative, or franchisee of Kyttx.
Nothing in these Operator Terms creates an employment, agency, partnership, fiduciary, franchise, joint venture, or representative relationship between you and Kyttx.
You are not authorized to bind Kyttx, make statements on behalf of Kyttx, accept legal obligations for Kyttx, represent that Kyttx endorses you, or represent that you are employed by or officially certified by Kyttx unless Kyttx expressly agrees in writing.
Your relationship with any Seller is between you and that Seller. Kyttx is not responsible for your agreement with any Seller, including compensation, revenue share, duties, performance, scope, termination, service quality, or disputes.
05Eligibility
You must be at least 18 years old to use Kyttx as an Operator.
By using Kyttx as an Operator, you represent and warrant that:
- You are at least 18 years old.
- You have legal capacity to enter into these Operator Terms.
- You have authority to act on behalf of any agency, company, or organization you represent.
- Your use of Kyttx is lawful.
- All information you provide is accurate, complete, current, and not misleading.
- You are not barred from using Kyttx under applicable law.
- You are not located in, organized under the laws of, ordinarily resident in, or acting on behalf of a sanctioned or restricted country, region, person, or entity.
- You will comply with all applicable laws, Kyttx Policies, Seller instructions, and Platform permissions.
Kyttx may restrict, suspend, or terminate Operator access if Kyttx determines that you are ineligible or create legal, payment, fraud, chargeback, security, sanctions, compliance, operational, reputational, or platform risk.
06Invitation and Authorization
You may access a Seller Account only if you have been invited or authorized by the relevant Seller or Kyttx.
You must not access, attempt to access, manage, modify, export, view, or use any Seller Account, Seller Content, Buyer Data, or Platform feature without proper authorization.
You must not exceed the permissions granted to you.
You must not use another person?s credentials to access a Seller Account.
You must not deceive a Seller, Buyer, or Kyttx about your identity, role, permissions, relationship, authority, or actions.
Kyttx may require verification, security checks, identity information, business information, tax information, or compliance information before or after granting Operator access.
07Permissions and Access Levels
Kyttx may provide permissions, roles, settings, restrictions, or access levels that control what Operators may do inside Seller Accounts.
Depending on permissions enabled by the Seller or Kyttx, an Operator may be able to:
- View Seller Account information.
- Create Seller Offerings.
- Edit Seller Offerings.
- Create or edit landing pages.
- Create or edit checkout pages.
- Create or edit funnels.
- Create or edit forms.
- Create or edit automations.
- Create or edit emails, SMS, or messages.
- View analytics.
- Manage customer workflows.
- View Buyer Data.
- Manage Buyer access.
- Issue refunds, if enabled.
- Manage community or content access.
- Upload files.
- Manage content.
- Configure integrations.
- Access other features allowed by the Seller or Kyttx.
Unless expressly enabled by Kyttx, Operators may not:
- Change Seller payout settings.
- Change bank account details.
- Change legal identity details.
- Change ownership information.
- Change tax information.
- Change KYC or verification information.
- Transfer Seller account ownership.
- Delete a Seller Account.
- Create unauthorized payout recipients.
- Access features outside assigned permissions.
- Bypass permission controls.
Kyttx may modify, restrict, remove, or override Operator permissions at any time.
08Seller Responsibility and Operator Responsibility
Sellers are responsible for actions taken by Operators they invite, authorize, or allow into their accounts.
However, Operators are also directly responsible to Kyttx for their own actions and omissions.
You are responsible for:
- Your use of the Platform.
- Your access to Seller Accounts.
- Your changes to Seller Content.
- Your changes to Seller Offerings.
- Your use of Buyer Data.
- Your communications.
- Your automations.
- Your funnels.
- Your checkout pages.
- Your marketing claims.
- Your violations of Kyttx Policies.
- Your violations of law.
- Your fraud, negligence, willful misconduct, or misrepresentations.
- Your breach of confidentiality.
- Your misuse of Platform features.
- Any harm caused by your actions or omissions.
Kyttx may enforce these Operator Terms against you directly, regardless of whether the relevant Seller is also responsible.
09Operator Services to Sellers
Kyttx does not control, supervise, guarantee, or endorse services Operators provide to Sellers.
Kyttx is not responsible for:
- Your performance for Sellers.
- Your failure to deliver services.
- Your compensation from Sellers.
- Your disputes with Sellers.
- Your contracts with Sellers.
- Seller dissatisfaction with your work.
- Seller claims against you.
- Your claims against Sellers.
- Your revenue-share agreements.
- Your agency agreements.
- Your off-platform work.
- Your representations to Sellers.
You and the Seller are responsible for defining your own relationship, scope of work, compensation, ownership, confidentiality, termination rights, and other terms.
Kyttx may provide tools that allow Operators and Sellers to collaborate, but those tools do not make Kyttx a party to Operator-Seller agreements.
11Refunds, Chargebacks, and Revenue Share Reversals
If you receive revenue share, commission, payout, or other compensation connected to a Seller transaction, that amount may be reversed, offset, deducted, delayed, or recovered if the underlying transaction is refunded, charged back, disputed, reversed, canceled, fraudulent, or subject to payment partner action.
You authorize Kyttx and Third-Party Payment Providers to deduct, reverse, offset, or recover amounts from your future payouts, balances, or payment methods where necessary or appropriate.
You are responsible for any negative balance created by refunds, chargebacks, disputes, reversals, fees, taxes, penalties, or payment partner actions related to amounts paid or payable to you.
12Buyer Data and Confidentiality
You may receive access to Buyer Data, Seller Content, Seller business information, revenue data, analytics, customer communications, payment-related data, strategy, funnels, automations, private materials, and other confidential information.
You must use such information only for authorized purposes connected to the Seller Account and only within the permissions granted to you.
You must not:
- Sell Buyer Data.
- Export Buyer Data without authorization.
- Share Buyer Data with unauthorized persons.
- Use Buyer Data for your own unrelated marketing.
- Use Buyer Data to compete with the Seller.
- Contact Buyers for unauthorized purposes.
- Disclose Seller confidential information.
- Use Seller confidential information for unrelated purposes.
- Copy Seller Content for your own benefit.
- Use Seller strategies, funnels, or data outside the authorized relationship.
- Retain Buyer Data after authorization ends unless legally permitted and authorized.
- Misuse analytics, revenue data, customer lists, or transaction data.
You must protect Buyer Data and Seller confidential information using reasonable administrative, technical, and organizational safeguards.
You must promptly notify the Seller and Kyttx if you suspect unauthorized access, misuse, loss, or disclosure of Buyer Data or confidential information.
13Privacy and Data Protection
You must comply with applicable privacy, data protection, marketing, anti-spam, and communications laws when accessing or using Buyer Data.
You must comply with the Kyttx Privacy Policy, Cookie Policy, and Data Processing Agreement where applicable.
You must process Buyer Data only as authorized by the Seller, Kyttx, and applicable law.
You must not use Buyer Data in a way that causes Kyttx, the Seller, or any Buyer to violate applicable privacy or data protection law.
Kyttx may restrict or revoke your access to Buyer Data where Kyttx determines that your access creates privacy, security, legal, compliance, reputational, or platform risk.
14Marketing, Claims, and Offer Creation
If you create or edit Seller Offerings, landing pages, checkout pages, sales copy, funnels, automations, ads, email copy, SMS copy, community posts, scripts, or other marketing materials, you are responsible for ensuring your work is lawful, truthful, substantiated, not misleading, and compliant with Kyttx Policies.
You must not create, publish, or assist with:
- False claims.
- Misleading claims.
- Unsupported income claims.
- Fake testimonials.
- Deceptive guarantees.
- Get-rich-quick claims.
- Unlawful health claims.
- Unlawful financial claims.
- Deceptive subscription terms.
- Hidden refund restrictions.
- Fake scarcity.
- Unlawful urgency claims.
- Misleading case studies.
- Prohibited or restricted Seller Offerings.
- Content that violates intellectual property rights.
- Content that violates privacy rights.
- Content that violates advertising or consumer protection law.
Kyttx may remove, restrict, or require changes to materials created or edited by Operators.
15Prohibited Operator Conduct
You must not:
- Access Seller Accounts without authorization.
- Exceed permissions granted to you.
- Bypass Platform permission controls.
- Use another person?s credentials.
- Misrepresent your identity or authority.
- Change payout settings unless expressly authorized and technically permitted by Kyttx.
- Steal, copy, leak, or misuse Seller Content.
- Steal, copy, leak, or misuse Buyer Data.
- Sell or misuse customer lists.
- Create misleading Seller Offerings.
- Create prohibited Seller Offerings.
- Make false claims to Buyers.
- Make false claims to Sellers.
- Impersonate Kyttx.
- Imply Kyttx endorsement without written approval.
- Interfere with Platform security.
- Exploit bugs or vulnerabilities.
- Upload malware.
- Spam Buyers.
- Harass Sellers, Buyers, Operators, or Kyttx staff.
- Use the Platform for fraud.
- Use the Platform for sanctions-restricted activity.
- Misuse payment, payout, refund, or revenue-share features.
- Delete, damage, or sabotage Seller accounts.
- Remove Buyer access without authorization.
- Issue refunds without authorization.
- Violate Kyttx Policies.
- Violate applicable law.
- Assist others in doing any of the above.
16Account Security
You are responsible for securing your Operator account, credentials, devices, connected services, API keys, sessions, and access.
You must:
- Use secure credentials.
- Not share credentials.
- Not allow unauthorized access.
- Promptly revoke access when appropriate.
- Promptly notify Kyttx and the relevant Seller of suspected unauthorized access.
- Comply with security requirements.
- Use multi-factor authentication if required or supported.
- Avoid using compromised devices or insecure networks where possible.
Kyttx may require password resets, session termination, additional verification, access restrictions, or other security measures.
17AI, Automations, and Generated Content
If you use Kyttx AI tools, automation tools, generated pages, generated copy, generated workflows, templates, recommendations, or analytics in connection with a Seller Account, you are responsible for reviewing, verifying, and approving all outputs before use.
You must not rely on AI or automated outputs as legal, tax, financial, investment, health, medical, regulatory, or professional advice.
You must ensure AI-generated or automated content complies with applicable law, Kyttx Policies, Seller instructions, and Buyer-facing disclosures.
Kyttx does not guarantee that AI or automation outputs will be accurate, lawful, compliant, non-infringing, suitable, or effective.
18Intellectual Property
You must ensure that any content, pages, templates, designs, copy, automations, files, workflows, or materials you create or upload through Kyttx do not infringe third-party rights.
You are responsible for having all rights, licenses, permissions, and consents necessary for materials you upload, create, edit, or submit.
You must not upload or use stolen content, copied templates, unauthorized designs, pirated files, infringing images, unauthorized music, third-party trademarks, or other protected materials without proper rights.
Kyttx may remove or restrict content in response to intellectual property complaints.
You agree to cooperate with Kyttx in resolving intellectual property complaints related to your actions.
19Ownership of Operator Work
Kyttx does not determine ownership of work created by an Operator for a Seller, except for Kyttx?s own intellectual property and Platform rights.
Ownership of pages, copy, automations, funnels, designs, files, templates, content, strategies, and other work created by an Operator for a Seller should be governed by the agreement between the Operator and Seller.
Kyttx is not responsible for disputes between Operators and Sellers about ownership, payment, licensing, deliverables, intellectual property, or access.
Regardless of ownership between you and a Seller, you grant Kyttx the license necessary to host, process, display, transmit, modify, and use such materials as needed to operate the Platform and provide services.
20Use of Kyttx Branding
You may not use Kyttx?s name, logo, trademarks, branding, screenshots, interface, documentation, or marketing materials in a way that suggests endorsement, certification, partnership, employment, official operator status, or agency relationship unless Kyttx expressly approves such use in writing.
You may truthfully state that you use Kyttx or help Sellers operate on Kyttx, provided the statement is not misleading.
Kyttx may require you to remove or modify references to Kyttx at any time.
21Disputes Between Operators and Sellers
Kyttx is not responsible for disputes between Operators and Sellers.
This includes disputes about:
- Payment.
- Revenue share.
- Commissions.
- Scope of work.
- Performance.
- Deliverables.
- Refunds.
- Termination.
- Ownership of work.
- Account access.
- Data access.
- Customer relationships.
- Confidentiality.
- Non-compete or non-solicit obligations.
- Service quality.
- Alleged misconduct.
Kyttx may, at its discretion, provide information, restrict account access, preserve records, or take action to protect the Platform, Buyers, Sellers, Operators, or Kyttx.
Kyttx?s decision to assist in one dispute does not obligate Kyttx to assist in any other dispute.
22Recordkeeping
You must maintain accurate records relating to your Operator services, Seller instructions, permissions, Buyer communications, automations, marketing materials, data exports, revenue share, taxes, and compliance.
You must provide records to Kyttx upon request where needed for:
- Disputes.
- Chargebacks.
- Refunds.
- Buyer complaints.
- Seller complaints.
- Payment partner requirements.
- Legal compliance.
- Tax compliance.
- Investigations.
- Enforcement.
- Fraud prevention.
- Security review.
- Risk review.
Failure to provide requested records may result in access restrictions, payout holds, reserves, suspension, or termination.
23Taxes
You are responsible for all taxes relating to compensation, revenue share, commissions, fees, payouts, or other amounts you receive from Sellers or through the Platform.
Kyttx may request tax information, business information, invoices, tax forms, or other documentation.
Kyttx may withhold, delay, restrict, or suspend payouts or revenue-share payments if tax or compliance information is missing, incomplete, inaccurate, suspicious, or required by law or payment partner rules.
Kyttx is not responsible for your tax obligations unless expressly required by law.
24Monitoring and Enforcement
Kyttx may monitor, audit, investigate, or review Operator activity, permissions, access logs, changes, data exports, Buyer communications, Seller complaints, Buyer complaints, revenue-share activity, refund activity, and Platform use.
Kyttx may use automated systems, manual review, AI tools, payment partner data, User reports, public information, third-party tools, or other methods to evaluate risk.
Kyttx may take enforcement action where it determines that Operator activity creates legal, payment, chargeback, privacy, security, compliance, operational, reputational, or platform risk.
25Access Restriction, Suspension, and Termination
Kyttx may restrict, suspend, revoke, or terminate your Operator account, Seller Account access, Buyer Data access, revenue-share access, payout eligibility, communication tools, data export ability, or any Platform features at any time, with or without notice, where Kyttx determines that:
- You violated these Operator Terms.
- You violated the Master Terms of Service.
- You violated Kyttx Policies.
- You violated Seller instructions.
- You exceeded permissions.
- You accessed data without authorization.
- You misused Buyer Data.
- You misused Seller Content.
- You created misleading Seller Offerings.
- You created prohibited Seller Offerings.
- You violated payment partner rules.
- You violated law.
- You created legal, payment, chargeback, compliance, fraud, security, operational, reputational, or platform risk.
- Your information is inaccurate or incomplete.
- You fail verification.
- You fail to provide requested information.
- You have a negative balance.
- You misuse Platform features.
- Third-Party Payment Providers require or recommend action.
- Kyttx is required or advised to act by law, regulators, banks, card networks, courts, arbitrators, or service providers.
- The Seller removes your access.
- Kyttx otherwise determines that action is necessary or appropriate.
26Effect of Termination
Upon restriction, suspension, revocation, or termination, Kyttx may:
- Disable your Operator account.
- Remove access to Seller Accounts.
- Remove access to Buyer Data.
- Disable revenue-share tools.
- Delay or freeze payouts.
- Impose reserves.
- Recover negative balances.
- Preserve records.
- Notify relevant Sellers.
- Notify affected Buyers where appropriate.
- Restrict data exports.
- Remove content you created.
- Cooperate with Sellers.
- Cooperate with payment partners.
- Cooperate with legal authorities.
- Take enforcement action.
- Pursue amounts owed.
Termination does not affect obligations arising before termination.
You remain responsible for:
- Confidentiality.
- Misuse of data.
- Misuse of content.
- Amounts owed.
- Refunds or reversals connected to compensation received.
- Taxes.
- Indemnification.
- Legal compliance.
- Dispute resolution obligations.
27No Guarantee of Work, Revenue, or Access
Kyttx does not guarantee that you will receive Seller clients, Operator opportunities, revenue share, commissions, payouts, continued account access, Seller invitations, platform visibility, or any business result.
Kyttx may change, discontinue, or restrict Operator-related features at any time.
You use the Platform as an Operator at your own risk.
28Disclaimer of Warranties
The Platform and Operator tools are provided on an ?as is? and ?as available? basis.
To the maximum extent permitted by law, Kyttx disclaims all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, security, accuracy, uninterrupted operation, error-free operation, and suitability for your business.
Kyttx does not warrant that:
- The Platform will be uninterrupted or error-free.
- Operator tools will meet your requirements.
- Sellers will pay you.
- Sellers will continue working with you.
- Revenue-share tools will remain available.
- Payouts will occur on a particular schedule.
- Data will always be available.
- Automations will work without issue.
- AI-generated content will be accurate or lawful.
29Limitation of Liability
To the maximum extent permitted by law, Kyttx and its owners, directors, officers, employees, contractors, agents, affiliates, licensors, service providers, and payment partners will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, enhanced, or similar damages, including lost profits, lost revenue, lost business, lost opportunities, lost goodwill, lost data, reputational harm, business interruption, failed payouts, lost commissions, lost revenue share, Seller disputes, Buyer disputes, account restrictions, or cost of substitute services.
To the maximum extent permitted by law, Kyttx?s total liability for any claim arising out of or relating to these Operator Terms, the Platform, your Operator account, your Seller Account access, your revenue share, your compensation, your Seller relationships, your Buyer Data access, or any dispute will not exceed the greater of:
- USD $100.
- The total platform fees actually paid to Kyttx by you during the three months immediately preceding the event giving rise to the claim.
If you did not directly pay platform fees to Kyttx, Kyttx?s total liability will not exceed USD $100, to the maximum extent permitted by law.
30Operator Indemnification
You agree to defend, indemnify, and hold harmless Kyttx and its owners, directors, officers, employees, contractors, agents, affiliates, licensors, service providers, and payment partners from and against any claims, demands, disputes, losses, liabilities, damages, fines, penalties, costs, and expenses, including reasonable legal fees, arising out of or relating to:
- Your use of the Platform.
- Your access to Seller Accounts.
- Your actions or omissions as an Operator.
- Your violation of these Operator Terms.
- Your violation of Kyttx Policies.
- Your violation of Seller instructions.
- Your violation of law.
- Your misuse of Buyer Data.
- Your misuse of Seller Content.
- Your breach of confidentiality.
- Your marketing claims.
- Your created or edited Seller Offerings.
- Your content, pages, automations, copy, files, or workflows.
- Your infringement of third-party rights.
- Your privacy violations.
- Your communications.
- Your fraud, negligence, willful misconduct, or misrepresentation.
- Your disputes with Sellers.
- Your disputes with Buyers.
- Your compensation or revenue-share disputes.
- Your taxes.
- Your negative balances.
- Your prohibited or restricted activities.
- Your breach of payment partner rules.
- Any claim that Kyttx is responsible for your services, work, promises, obligations, or conduct.
Kyttx may control the defense of any indemnified claim at your expense.
You may not settle any claim without Kyttx?s prior written consent if the settlement imposes obligations on Kyttx, admits fault by Kyttx, or affects Kyttx?s rights.
31Release
To the maximum extent permitted by law, you release Kyttx from claims, demands, damages, losses, liabilities, and disputes arising out of or relating to:
- Seller relationships.
- Seller disputes.
- Buyer disputes.
- Compensation disputes.
- Revenue-share disputes.
- Seller instructions.
- Seller account restrictions.
- Seller termination.
- Payment partner decisions.
- Payout delays.
- Chargebacks.
- Refunds.
- Negative balances.
- Third-party services.
- Lost work opportunities.
- Changes to Operator tools.
32Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Operator Terms, the Platform, your Operator account, your Seller Account access, Buyer Data, Seller Content, revenue share, payouts, compensation, account restrictions, termination, or your relationship with Kyttx will be resolved according to the Arbitration & Dispute Resolution Agreement and the dispute resolution provisions in the Kyttx Master Terms of Service.
Unless mandatory law requires otherwise:
- Governing law shall be the laws of the Dubai International Financial Centre.
- Arbitration shall be administered by the Dubai International Arbitration Centre.
- The seat of arbitration shall be the Dubai International Financial Centre, Dubai, United Arab Emirates.
- The language shall be English.
- The tribunal shall consist of one arbitrator.
- Disputes shall be confidential.
- Claims must be brought individually and not as class, collective, consolidated, representative, or group claims.
- The prevailing party may recover costs and legal fees where permitted.
Before commencing arbitration, the party raising the dispute must provide written notice and allow 30 days for informal resolution.
Kyttx may seek urgent court relief for intellectual property misuse, fraud, security threats, platform abuse, confidentiality breaches, non-payment, chargebacks, data misuse, sanctions issues, illegal activity, or other urgent harm.
33Modifications
Kyttx may modify these Operator Terms from time to time.
Kyttx may provide notice by posting an updated version, updating the ?Last Updated? date, sending email notice, displaying in-app notice, or using another reasonable method.
Changes are effective when posted or when otherwise stated.
Your continued use of the Platform as an Operator after changes become effective constitutes acceptance of the updated Operator Terms.
Kyttx may make immediate changes where required or appropriate due to legal requirements, payment partner requirements, security issues, fraud risk, compliance issues, operational changes, or urgent platform needs.
34Assignment
You may not assign, transfer, delegate, or sublicense your rights or obligations under these Operator Terms without Kyttx?s prior written consent.
Kyttx may assign, transfer, delegate, license, or sublicense its rights and obligations under these Operator Terms without your consent, including in connection with incorporation, reorganization, merger, acquisition, asset sale, financing, restructuring, change of control, transfer to a Dubai or UAE entity, transfer to a DIFC entity, or operation through another legal entity.
35Survival
Any provisions that by their nature should survive termination will survive, including provisions relating to payments, revenue share, reversals, refunds, chargebacks, reserves, offsets, taxes, ownership, licenses, confidentiality, disclaimers, limitation of liability, indemnification, dispute resolution, governing law, arbitration, data retention, enforcement, and compliance.
