Content & Intellectual Property Policy

01Introduction

This Content & Intellectual Property Policy governs content ownership, content licenses, uploaded materials, hosted content, intellectual property rights, copyright complaints, trademark complaints, repeat infringers, Buyer access restrictions, Seller Content, Buyer submissions, Operator-created content, Kyttx intellectual property, publicity rights, and content enforcement through or in connection with the Kyttx Platform.

This Policy applies to all Users, including Sellers, Merchants, Buyers, Customers, Members, Operators, agencies, team members, contractors, affiliates, visitors, and any other person or entity that accesses or uses Kyttx.

This Policy is incorporated into and forms part of the Kyttx Master Terms of Service, Seller / Merchant Agreement, Buyer / Member Terms, Operator / Agency Terms, Payment, Payout & Fee Schedule, Refund, Chargeback & Dispute Policy, Acceptable Use Policy, Privacy Policy, Data Processing Agreement, Arbitration & Dispute Resolution Agreement, and other applicable Kyttx Policies.

By uploading, creating, hosting, posting, submitting, transmitting, accessing, downloading, purchasing, selling, managing, displaying, sharing, or otherwise using Content through or in connection with Kyttx, you agree to this Policy.

If you do not agree to this Policy, you must not use Kyttx.

02Relationship to Other Terms

This Policy applies in addition to all other Kyttx terms and policies.

If there is a conflict between this Policy and the Kyttx Master Terms of Service, this Policy controls for content and intellectual-property-specific matters unless expressly stated otherwise.

If there is a conflict between this Policy and the Acceptable Use Policy, the stricter rule may apply.

If applicable law, payment provider rules, platform security requirements, or third-party rights impose stricter requirements, those stricter requirements may apply.

03Definitions

Capitalized terms used but not defined in this Policy have the meanings given in the Kyttx Master Terms of Service.

For purposes of this Policy:

?Content? means any text, images, videos, audio, files, documents, downloads, templates, courses, lessons, posts, comments, forms, submissions, responses, landing pages, checkout pages, sales pages, storefronts, communities, messages, emails, SMS, workflows, automations, designs, graphics, logos, trademarks, branding, code, data, analytics, links, URLs, metadata, recordings, transcripts, materials, or other information uploaded, created, submitted, hosted, transmitted, displayed, published, accessed, or otherwise made available through or in connection with Kyttx.

?Seller Content? means Content uploaded, created, submitted, hosted, transmitted, displayed, published, sold, or made available by or on behalf of a Seller.

?Buyer Content? means Content uploaded, submitted, posted, transmitted, or provided by or on behalf of a Buyer, Customer, Member, purchaser, subscriber, or participant.

?Operator Content? means Content uploaded, created, submitted, hosted, transmitted, displayed, published, edited, or configured by or on behalf of an Operator, agency, contractor, consultant, team member, or service provider.

?User Content? means Seller Content, Buyer Content, Operator Content, and any other Content provided by Users.

?Kyttx Content? means Content owned, licensed, created, provided, or made available by Kyttx, including Platform software, design, interface, workflows, documentation, templates, graphics, branding, trademarks, code, tools, systems, and other proprietary materials.

?Intellectual Property Rights? means copyright, trademarks, service marks, trade names, trade dress, patents, design rights, database rights, trade secrets, moral rights, publicity rights, privacy rights, domain rights, know-how, confidential information rights, and other proprietary rights anywhere in the world.

04User Responsibility for Content

You are solely responsible for User Content that you upload, create, submit, host, transmit, publish, display, sell, share, access, or otherwise make available through or in connection with Kyttx.

You represent and warrant that:

• You own or have all rights necessary to use your User Content.
• Your User Content does not infringe Intellectual Property Rights.
• Your User Content does not violate privacy rights.
• Your User Content does not violate publicity rights.
• Your User Content is lawful.
• Your User Content is accurate where presented as factual.
• Your User Content is not misleading.
• Your User Content does not contain malware or harmful code.
• Your User Content does not violate Kyttx Policies.
• Your User Content does not violate payment provider rules.
• Your User Content does not create legal, payment, chargeback, privacy, security, reputational, compliance, or platform risk.

Kyttx is not responsible for User Content and does not guarantee that User Content is lawful, accurate, complete, non-infringing, safe, available, or suitable.

05Seller Content Ownership

As between Kyttx and a Seller, the Seller retains ownership of Seller Content, subject to the rights granted to Kyttx and any rights granted to Buyers, Operators, or third parties.

Sellers are responsible for ensuring they have all rights, licenses, permissions, consents, and authorizations necessary to upload, host, sell, display, transmit, distribute, and provide access to Seller Content.

Sellers must not upload, host, sell, distribute, or provide access to Content they do not own or have the right to use.

Sellers are responsible for Content uploaded or created by their Operators, team members, contractors, employees, agencies, affiliates, and other authorized users.

06License from Sellers to Kyttx

By uploading, creating, submitting, hosting, transmitting, publishing, displaying, selling, or making available Seller Content through or in connection with Kyttx, the Seller grants Kyttx a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, process, transmit, display, perform, publish, distribute, modify, adapt, format, translate, create technical copies of, and otherwise use Seller Content as necessary or appropriate to:

• Operate the Platform.
• Provide services to Sellers, Buyers, Operators, and Users.
• Host Seller Offerings.
• Display storefronts, pages, and checkout flows.
• Provide Buyer access.
• Process purchases.
• Support subscriptions, payment plans, trials, or memberships.
• Manage access control.
• Perform automations.
• Send communications.
• Provide analytics.
• Provide support.
• Troubleshoot issues.
• Test and improve the Platform.
• Comply with law.
• Enforce Kyttx Policies.
• Prevent fraud or abuse.
• Manage chargebacks and disputes.
• Preserve records.
• Protect the Platform and Users.
• Exercise Kyttx?s rights under applicable agreements.

This license continues for as long as necessary to provide the Platform, comply with law, enforce agreements, resolve disputes, preserve records, or protect Kyttx?s rights.

07License from Buyers to Kyttx

By uploading, submitting, posting, transmitting, or providing Buyer Content through or in connection with Kyttx, the Buyer grants Kyttx a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, process, transmit, display, perform, modify, format, and otherwise use Buyer Content as necessary or appropriate to:

• Operate the Platform.
• Provide access to Seller Offerings.
• Support Buyer participation.
• Transmit Buyer Content to Sellers where appropriate.
• Provide support.
• Troubleshoot issues.
• Comply with law.
• Enforce Kyttx Policies.
• Prevent fraud or abuse.
• Manage refunds, chargebacks, and disputes.
• Preserve records.
• Protect the Platform and Users.

Buyers may also grant rights to Sellers under Seller terms or community rules.

08License from Operators to Kyttx

By uploading, creating, submitting, editing, configuring, hosting, transmitting, publishing, displaying, or making available Operator Content through or in connection with Kyttx, the Operator grants Kyttx a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, process, transmit, display, perform, publish, distribute, modify, adapt, format, translate, and otherwise use Operator Content as necessary or appropriate to:

• Operate the Platform.
• Provide services to Sellers, Buyers, Operators, and Users.
• Support Seller accounts.
• Host Seller Offerings.
• Display pages, storefronts, checkout flows, and automations.
• Provide Buyer access.
• Process transactions.
• Provide analytics.
• Provide support.
• Troubleshoot issues.
• Comply with law.
• Enforce Kyttx Policies.
• Prevent fraud or abuse.
• Manage disputes.
• Preserve records.
• Protect the Platform and Users.

Ownership of Operator-created work as between Seller and Operator is governed by their own agreement. Kyttx is not responsible for disputes between Sellers and Operators about ownership, licensing, payment, scope, deliverables, or access.

09Buyer Access to Seller Content

Buyers may access Seller Content only as permitted by the applicable Seller, the Seller Offering, Kyttx Policies, and applicable law.

Unless expressly permitted, Buyers must not:

• Copy Seller Content.
• Reproduce Seller Content.
• Download Seller Content.
• Scrape Seller Content.
• Resell Seller Content.
• Redistribute Seller Content.
• Leak Seller Content.
• Publish Seller Content elsewhere.
• Share Seller Content with others.
• Share account access.
• Bypass access controls.
• Remove copyright, trademark, or proprietary notices.
• Create competing products using Seller Content.
• Train models or systems on Seller Content without permission.
• Use Seller Content after a refund, chargeback, cancellation, or access termination unless expressly permitted.

Violations may result in loss of access, account termination, legal claims by Sellers, legal claims by Kyttx, or other enforcement action.

10Content Created Using Kyttx Tools

Kyttx may provide tools that allow Users to create landing pages, storefronts, checkout pages, automations, emails, SMS, forms, communities, course materials, files, workflows, AI-generated content, templates, analytics, and other materials.

Unless expressly stated otherwise, Users are responsible for Content they create using Kyttx tools.

Kyttx does not guarantee that Content generated, suggested, formatted, automated, or created using Kyttx tools will be lawful, accurate, non-infringing, suitable, compliant, or effective.

Users must review and approve all Content before publishing or using it.

Kyttx retains ownership of the Platform, software, systems, tools, templates, design elements, workflows, code, infrastructure, and Kyttx Content, even if those tools are used to create User Content.

11AI-Generated Content

Kyttx may provide AI-assisted tools that generate or suggest Content.

Users are solely responsible for reviewing, verifying, editing, approving, and legally clearing AI-generated Content before use.

AI-generated Content must not be used to:

• Make false claims.
• Create fake testimonials.
• Create fake reviews.
• Impersonate others.
• Infringe Intellectual Property Rights.
• Violate privacy rights.
• Provide regulated professional advice without proper authorization.
• Create illegal content.
• Create spam.
• Create phishing content.
• Mislead Buyers.
• Violate Kyttx Policies.

Kyttx does not guarantee that AI-generated Content is unique, non-infringing, accurate, lawful, compliant, or suitable for any purpose.

12Prohibited Content

You must not upload, create, host, transmit, publish, sell, display, access, or make available Content that:

• Is illegal.
• Is fraudulent.
• Is misleading.
• Is deceptive.
• Infringes Intellectual Property Rights.
• Violates privacy rights.
• Violates publicity rights.
• Contains malware.
• Facilitates phishing.
• Facilitates hacking.
• Facilitates fraud.
• Facilitates chargeback abuse.
• Facilitates refund abuse.
• Promotes scams.
• Promotes get-rich-quick schemes.
• Contains false income claims.
• Contains false health claims.
• Contains unlawful financial claims.
• Is sexually explicit.
• Involves adult content.
• Exploits minors.
• Promotes gambling or betting without approval.
• Promotes illegal drugs.
• Promotes weapons or restricted goods.
• Promotes hate or violence.
• Harasses or abuses others.
• Contains threats.
• Contains doxxing.
• Contains confidential information without authorization.
• Contains stolen files.
• Contains pirated materials.
• Contains fake documents.
• Violates sanctions or export controls.
• Violates Kyttx Policies.
• Creates legal, payment, chargeback, privacy, security, reputational, compliance, or platform risk.

Kyttx may remove, restrict, or disable Content at any time.

13Content Monitoring and Review

Kyttx may review, monitor, scan, audit, investigate, remove, disable, restrict, or preserve Content where Kyttx determines that action is necessary or appropriate.

Kyttx may use:

• Automated systems.
• AI tools.
• Manual review.
• User reports.
• Payment provider data.
• Fraud signals.
• Public information.
• Third-party tools.
• Legal notices.
• Rights holder complaints.
• Regulator requests.
• Other relevant information.

Kyttx has no obligation to monitor all Content.

Kyttx is not responsible for failing to detect unlawful, infringing, misleading, or prohibited Content.

14Content Removal

Kyttx may remove, disable, restrict, or block access to Content at any time, with or without notice, where Kyttx determines that:

• Content violates Kyttx Policies.
• Content may violate law.
• Content may infringe rights.
• Content creates legal risk.
• Content creates payment risk.
• Content creates chargeback risk.
• Content creates privacy risk.
• Content creates security risk.
• Content creates reputational risk.
• Content creates compliance risk.
• Content is subject to a complaint.
• Content is subject to a takedown request.
• Content is linked to prohibited activity.
• Content is misleading or unsafe.
• Removal is requested or required by a payment provider, bank, card network, regulator, court, arbitrator, or legal authority.
• Removal is otherwise appropriate.

Kyttx is not liable for losses resulting from Content removal, including lost sales, lost revenue, lost access, Buyer complaints, reputational harm, or business interruption, except to the extent liability cannot be excluded by law.

15Seller Content After Termination

If a Seller account is suspended, restricted, or terminated, Kyttx may:

• Disable Seller Content.
• Remove Seller Content.
• Preserve Seller Content.
• Restrict Buyer access.
• Allow limited Buyer access.
• Notify Buyers.
• Provide limited Seller access for export.
• Preserve records for legal or payment reasons.
• Cooperate with payment providers.
• Cooperate with legal authorities.
• Delete Seller Content.
• Take other action Kyttx determines appropriate.

Kyttx is not required to continue hosting Seller Content after account termination.

Users are responsible for maintaining independent backups of Content.

16Data Export and Content Backups

Kyttx may provide tools to export certain Content or data where technically available and legally permitted.

Kyttx may restrict or deny exports where:

• The account is suspended.
• The account is under investigation.
• Export would violate privacy rights.
• Export would violate Kyttx Policies.
• Export would violate law.
• Export would expose Buyer Data improperly.
• Export would create security risk.
• Export would violate payment provider requirements.
• Export would interfere with an investigation.
• Kyttx determines export is inappropriate.

Kyttx does not guarantee permanent storage or backup of User Content.

Users should maintain their own backups.

17Kyttx Intellectual Property

Kyttx and its licensors own all rights, title, and interest in and to the Platform and Kyttx Content.

This includes:

• Software.
• Code.
• Source code.
• Object code.
• Architecture.
• Systems.
• Workflows.
• Databases.
• Dashboards.
• Interfaces.
• Designs.
• Graphics.
• Templates.
• Components.
• Features.
• Documentation.
• Trademarks.
• Logos.
• Branding.
• Trade names.
• Service marks.
• Domain names.
• Business methods.
• Product names.
• Analytics systems.
• AI tools.
• Automation tools.
• Checkout tools.
• Hosted page tools.
• Access control systems.

No rights are granted to Kyttx intellectual property except as expressly stated in Kyttx?s terms.

You must not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, scrape, exploit, or create derivative works from Kyttx intellectual property except as expressly permitted.

18Kyttx Branding

You may not use Kyttx?s name, logo, trademarks, branding, screenshots, interface, trade dress, or materials in a way that suggests:

• Endorsement.
• Certification.
• Partnership.
• Employment.
• Agency.
• Guarantee.
• Sponsorship.
• Official approval.
• Special status.
• Responsibility by Kyttx.

You may truthfully state that you use Kyttx, provided the statement is accurate, not misleading, and complies with Kyttx Policies.

Kyttx may require you to remove or modify any use of Kyttx branding at any time.

19Feedback

If you provide ideas, suggestions, feedback, feature requests, recommendations, improvements, bug reports, comments, or other input about Kyttx, you grant Kyttx a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to use, modify, commercialize, incorporate, develop, publish, distribute, and exploit such feedback without restriction, attribution, or compensation.

Kyttx has no obligation to use feedback.

20Publicity Rights

Unless you notify Kyttx otherwise in writing, Sellers grant Kyttx the right to use Seller names, business names, trade names, logos, trademarks, public storefronts, public Seller Offering descriptions, screenshots of public pages, public profiles, and general descriptions of Seller use of the Platform for marketing, promotional, customer list, investor, sales, case study, and business development purposes.

Kyttx may use aggregated or anonymized performance, usage, transaction, or analytics data for benchmarking, analytics, marketing, product improvement, and business purposes, provided such use does not identify confidential information where prohibited by law.

21Copyright Complaints

If you believe Content on Kyttx infringes your copyright, you may send a copyright complaint to:

legal@kyttx.com

Your complaint should include:

• Your full legal name.
• Your company name, if applicable.
• Your contact email.
• Your mailing address.
• Your phone number, if available.
• Identification of the copyrighted work you claim was infringed.
• Identification of the allegedly infringing Content.
• The URL or location of the allegedly infringing Content.
• A statement that you have a good-faith belief that use of the Content is not authorized by the copyright owner, its agent, or law.
• A statement that the information in your notice is accurate.
• A statement that you are the copyright owner or authorized to act on behalf of the copyright owner.
• Your physical or electronic signature.

Kyttx may remove or disable access to allegedly infringing Content in response to copyright complaints.

Kyttx may forward your complaint to the User who posted or provided the Content.

22Copyright Counter-Notices

If your Content was removed due to a copyright complaint and you believe the removal was mistaken or unauthorized, you may submit a counter-notice to:

Your counter-notice should include:

• Your full legal name.
• Your company name, if applicable.
• Your contact email.
• Your mailing address.
• Your phone number, if available.
• Identification of the removed Content.
• The URL or location where the Content appeared before removal.
• A statement explaining why you believe the Content was removed by mistake or misidentification.
• A statement that you consent to the applicable dispute resolution process under Kyttx?s terms.
• A statement that the information in your counter-notice is accurate.
• Your physical or electronic signature.

Kyttx may restore Content at its discretion, subject to applicable law, legal risk, payment provider requirements, and Kyttx Policies.

Kyttx is not required to restore Content.

23Trademark Complaints

If you believe Content on Kyttx infringes your trademark rights, you may send a trademark complaint to:

Your complaint should include:

• Your full legal name.
• Your company name, if applicable.
• Your contact email.
• Your mailing address.
• Your phone number, if available.
• Identification of the trademark.
• Registration number, if registered.
• Jurisdiction of registration, if registered.
• Description of your trademark rights.
• Identification of the allegedly infringing Content.
• The URL or location of the allegedly infringing Content.
• Explanation of why the use is infringing or misleading.
• A statement that the information in your complaint is accurate.
• A statement that you are the trademark owner or authorized to act on behalf of the trademark owner.
• Your physical or electronic signature.

Kyttx may remove or restrict Content in response to trademark complaints.

Kyttx may forward your complaint to the User who posted or provided the Content.

24Other Intellectual Property Complaints

Kyttx may also review complaints involving:

• Trade secrets.
• Publicity rights.
• Privacy rights.
• Design rights.
• Patent rights.
• Database rights.
• Counterfeit goods.
• Impersonation.
• Unauthorized use of likeness.
• Unauthorized use of brand assets.
• Stolen content.
• Leaked content.
• Confidential information.

Complaints should be sent to:

Kyttx may request additional information before taking action.

25Repeat Infringers

Kyttx may suspend or terminate accounts of Users who repeatedly infringe or are repeatedly accused of infringing Intellectual Property Rights.

Kyttx may determine repeat infringer status based on:

• Number of complaints.
• Credibility of complaints.
• Legal risk.
• User history.
• Content type.
• Severity of infringement.
• Failure to respond.
• Failure to remove infringing Content.
• Repeated uploading of similar Content.
• Other relevant factors.

Kyttx may terminate repeat infringers with or without prior notice.

26False or Abusive Complaints

You must not submit false, misleading, abusive, fraudulent, retaliatory, or bad-faith intellectual property complaints.

Kyttx may restrict, suspend, or terminate accounts that abuse complaint processes.

You may be liable for damages, costs, legal fees, and other consequences if you submit false or bad-faith complaints.

27Infringement by Buyers

Buyers must not copy, leak, resell, redistribute, publish, share, download, scrape, or misuse Seller Content unless expressly permitted.

Sellers may report Buyer infringement to Kyttx.

Kyttx may suspend or terminate Buyer access where Kyttx determines that Buyer conduct violates this Policy.

Kyttx may share relevant records with Sellers, payment providers, legal advisors, courts, arbitrators, regulators, or law enforcement where appropriate.

28Infringement by Operators

Operators must not copy, steal, leak, reuse, resell, or misuse Seller Content, Buyer Data, Seller strategies, funnels, automations, templates, pages, or other protected materials.

Kyttx may restrict, suspend, or terminate Operator access where Kyttx determines that Operator conduct violates this Policy.

Kyttx may share relevant records with Sellers, Buyers, payment providers, legal advisors, courts, arbitrators, regulators, or law enforcement where appropriate.

29Confidential Information

Users must not upload, publish, share, access, use, export, or disclose confidential information without authorization.

Confidential information may include:

• Buyer Data.
• Seller Data.
• Customer lists.
• Transaction records.
• Payment information.
• Business strategies.
• Sales scripts.
• Internal documents.
• Trade secrets.
• Private communications.
• Unpublished materials.
• Security information.
• Access credentials.
• Private account data.
• Non-public Kyttx information.

Kyttx may remove or restrict Content that appears to disclose confidential information.

30Content Involving Personal Data

Content that includes personal data must comply with applicable privacy and data protection laws and Kyttx?s Privacy Policy and Data Processing Agreement.

Users must not upload or share personal data unless they have a lawful basis and all required rights, notices, consents, or permissions.

Users must not upload sensitive personal data unless necessary, lawful, properly protected, and permitted by Kyttx.

Kyttx may remove or restrict Content involving personal data where Kyttx determines that it creates privacy, security, legal, or compliance risk.

31Recordings, Calls, and Events

If you record calls, events, sessions, coaching calls, webinars, community sessions, or other interactive activities, you are responsible for complying with applicable recording, consent, privacy, and communications laws.

You must obtain all required consents before recording or sharing recordings.

You must not upload or share recordings containing another person?s voice, image, likeness, personal information, confidential information, or protected content without proper rights.

Kyttx may remove or restrict recordings where necessary or appropriate.

32Community Content

Sellers may operate communities, member areas, comments, discussions, chats, or other interactive spaces through Kyttx.

Sellers are responsible for moderating Seller-controlled communities and ensuring community rules comply with Kyttx Policies.

Community Users must not post Content that violates this Policy.

Kyttx may remove community Content or restrict community access where Kyttx determines that action is necessary or appropriate.

33File Hosting

If Kyttx provides file hosting, Users must not upload or host files that:

• Are illegal.
• Are stolen.
• Are pirated.
• Infringe rights.
• Contain malware.
• Contain phishing tools.
• Contain fake documents.
• Contain confidential information without authorization.
• Contain personal data without legal basis.
• Contain adult content.
• Contain gambling content.
• Contain prohibited financial or health claims.
• Violate Kyttx Policies.
• Create security, legal, or platform risk.

Kyttx may scan, restrict, remove, quarantine, or disable files at any time.

34URLs, Links, and Redirects

Content may include URLs, links, redirects, custom domains, or shortened links.

You must not use URLs, links, redirects, custom domains, or shortened links to:

• Mislead Users.
• Hide prohibited content.
• Bypass Kyttx review.
• Redirect to phishing pages.
• Redirect to malware.
• Redirect to scams.
• Redirect to gambling or betting.
• Redirect to adult content.
• Redirect to illegal offers.
• Redirect to infringing content.
• Evade payment provider rules.
• Evade Kyttx Policies.

Kyttx may disable, remove, rewrite, block, or restrict links, redirects, URLs, custom domains, or shortened links at any time.

35Content Preservation

Kyttx may preserve Content and related records where necessary or appropriate for:

• Legal compliance.
• Payment provider requirements.
• Intellectual property disputes.
• Refund disputes.
• Chargeback disputes.
• Buyer complaints.
• Seller disputes.
• Operator disputes.
• Investigations.
• Law enforcement requests.
• Regulator requests.
• Arbitration.
• Litigation.
• Tax compliance.
• Security.
• Fraud prevention.
• Enforcement.
• Business operations.

Kyttx may preserve Content even after deletion from public view or account termination.

36Cooperation with Rights Holders and Authorities

Kyttx may cooperate with rights holders, legal authorities, regulators, courts, arbitrators, law enforcement, payment providers, banks, card networks, service providers, and advisors where Kyttx determines cooperation is necessary or appropriate.

This may include sharing:

• Account information.
• Content.
• Transaction records.
• Access logs.
• Communications.
• IP addresses.
• Device information.
• Payment status.
• Dispute records.
• Complaint records.
• Other relevant information.

Information sharing will be handled in accordance with applicable law and Kyttx?s Privacy Policy.

37Platform Enforcement

If Kyttx determines that Content or User activity violates this Policy, Kyttx may take any action it determines appropriate, including:

• Warning.
• Request for changes.
• Content removal.
• File removal.
• Link disabling.
• Page removal.
• Storefront removal.
• Checkout disabling.
• Community restriction.
• Buyer access removal.
• Operator access removal.
• Seller Offering removal.
• Account restriction.
• Account suspension.
• Account termination.

• Payout holds.
• Reserves.
• Refunds.
• Reporting to payment providers.
• Reporting to rights holders.
• Reporting to regulators.
• Reporting to law enforcement.
• Arbitration or legal action.
• Any other action Kyttx determines necessary.

Kyttx may take enforcement action with or without prior notice.

38No Obligation to Host Content

Kyttx has no obligation to host, store, publish, display, transmit, maintain, preserve, or continue providing access to any User Content.

Kyttx may remove or restrict Content at any time as permitted by Kyttx Policies and applicable law.

Kyttx is not liable for Content loss, deletion, removal, restriction, access loss, or failure to preserve Content, except to the extent liability cannot be excluded by law.

39Disclaimers

Kyttx does not guarantee that User Content is lawful, accurate, complete, non-infringing, safe, available, or suitable.

Kyttx does not endorse User Content.

Kyttx is not responsible for User Content, Seller Content, Buyer Content, Operator Content, intellectual property disputes between Users, Buyer misuse of Seller Content, Operator misuse of Seller Content, or third-party claims, except to the extent liability cannot be excluded by law.

Use of Content through Kyttx is at your own risk.

40Limitation of Liability

To the maximum extent permitted by law, Kyttx is not liable for losses arising out of or relating to:

• User Content.
• Seller Content.
• Buyer Content.
• Operator Content.
• Content removal.
• Content restriction.
• Content deletion.
• Content access loss.
• Intellectual property disputes.
• Copyright complaints.
• Trademark complaints.
• Takedown requests.
• False complaints.
• Buyer misuse of Seller Content.
• Operator misuse of Seller Content.
• Seller infringement.
• Third-party infringement claims.
• Loss of sales.
• Lost revenue.
• Lost profits.
• Reputational harm.
• Business interruption.
• Indirect or consequential damages.

Kyttx?s liability is limited as provided in the Kyttx Master Terms of Service and applicable agreements.

41Indemnification

You agree to defend, indemnify, and hold harmless Kyttx and its owners, directors, officers, employees, contractors, agents, affiliates, licensors, service providers, and payment partners from and against any claims, demands, disputes, losses, liabilities, damages, fines, penalties, costs, and expenses, including reasonable legal fees, arising out of or relating to:

• Your Content.
• Your User Content.
• Your Seller Content.
• Your Buyer Content.
• Your Operator Content.
• Your infringement of Intellectual Property Rights.
• Your violation of privacy rights.
• Your violation of publicity rights.
• Your unauthorized use of Content.
• Your misuse of Seller Content.
• Your misuse of Buyer Data.
• Your misuse of confidential information.
• Your copyright complaints.
• Your trademark complaints.
• Your false or bad-faith complaints.
• Your violation of this Policy.
• Your violation of Kyttx Policies.
• Your violation of law.
• Any claim that Kyttx is responsible for your Content or conduct.

42Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to this Policy, User Content, Content removal, copyright complaints, trademark complaints, intellectual property disputes, Kyttx intellectual property, confidentiality, Content access, Content restrictions, or related enforcement actions will be resolved according to the Kyttx Arbitration & Dispute Resolution Agreement and the dispute resolution provisions in the Kyttx Master Terms of Service.

Unless mandatory law requires otherwise:

• Governing law shall be the laws of the Dubai International Financial Centre.
• Arbitration shall be administered by the Dubai International Arbitration Centre.
• The seat of arbitration shall be the Dubai International Financial Centre, Dubai, United Arab Emirates.
• The language shall be English.
• The tribunal shall consist of one arbitrator.
• Disputes shall be confidential.
• Claims must be brought individually and not as class, collective, consolidated, representative, or group claims.
• The prevailing party may recover costs and legal fees where permitted.

Before commencing arbitration, the party raising the dispute must provide written notice and allow 30 days for informal resolution.

Kyttx may seek urgent court relief for intellectual property misuse, infringement, confidentiality breaches, data misuse, security threats, fraud, illegal activity, or other urgent harm.

43Modifications

Kyttx may modify this Policy from time to time.

Kyttx may provide notice by posting an updated version, updating the ?Last Updated? date, sending email notice, displaying in-app notice, updating the dashboard, or using another reasonable method.

Changes are effective when posted or when otherwise stated.

Your continued use of the Platform after changes become effective constitutes acceptance of the updated Policy.

Kyttx may make immediate changes where required or appropriate due to legal requirements, intellectual property requirements, payment partner requirements, security issues, fraud risk, compliance issues, operational changes, or urgent platform needs.

44Survival

Obligations under this Policy survive account suspension, account termination, Seller Offering removal, Buyer access termination, Content removal, payout completion, transaction completion, or discontinuation of the Platform.

Surviving obligations include obligations relating to:

• Ownership.
• Licenses.
• Intellectual property.
• Confidentiality.
• Content restrictions.
• Buyer access restrictions.
• Takedown processes.
• Indemnification.
• Dispute resolution.
• Legal compliance.
• Record retention.
• Enforcement.
